1. Acceptance of Terms

Welcome to ServeProxy. By accessing or using our image content delivery network service (the "Service") located at serveproxy.com, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ServeProxy ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

ServeProxy provides a free image content delivery network that optimizes and caches images to improve website performance. The Service includes:

• Automatic image optimization and conversion to modern formats (AVIF, WebP)
• Global content delivery through edge caching
• Bandwidth reduction and load time improvements
• DDoS protection and security features

The Service is provided "as is" without requiring user registration or payment. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service to host, cache, or distribute illegal, harmful, or inappropriate content
• Use the Service to distribute malware, viruses, or malicious code
• Cache or distribute copyrighted material without proper authorization
• Use the Service to host adult content, violent imagery, or hate speech
• Attempt to circumvent rate limits or security measures
• Use automated systems to abuse or overload the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service in a manner that could damage, disable, or impair our servers or networks
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to violate any applicable laws or regulations

4. Usage Limits and Rate Limiting

To ensure fair usage and service stability, the following limits apply:

• Request Limit: 5,000 uncached requests per 10-minute period per IP address
• File Size Limit: Maximum 5 MB per image file
• Timeout: Image downloads must complete within 15 seconds
• Blocking: IP addresses exceeding rate limits will be blocked for 1 hour

Cached requests (requests for previously processed images) do not count toward rate limits. We reserve the right to adjust these limits at any time to maintain service quality.

5. Content Responsibility

You are solely responsible for the images you request through the Service. By using the Service to cache an image, you represent and warrant that:

• You have the legal right to use, distribute, and display the image
• The image does not infringe upon any third-party intellectual property rights
• The image does not violate any applicable laws or regulations
• The image complies with our Acceptable Use Policy

We do not review, monitor, or verify the legality of content cached through the Service. We are not responsible for user-submitted content and disclaim all liability for such content.

6. Intellectual Property Rights

6.1 Service Ownership

The Service, including its code, design, features, and infrastructure, is owned by ServeProxy and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

6.2 User Content

You retain all ownership rights to images you request through the Service. By using the Service, you grant us a limited, non-exclusive, worldwide license to cache, optimize, and deliver your images solely for the purpose of providing the Service.

6.3 Copyright Infringement

We respect intellectual property rights. If you believe content cached through our Service infringes your copyright, please contact us at [email protected] with:

• A description of the copyrighted work
• The URL of the infringing content through our Service
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that your notification is accurate and you are the copyright owner or authorized to act on their behalf

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE QUALITY, ACCURACY, OR RELIABILITY OF THE SERVICE
• WARRANTIES THAT DEFECTS WILL BE CORRECTED

We do not guarantee that the Service will meet your requirements or that it will be available at any particular time. We may experience technical difficulties, perform maintenance, or make updates at any time.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVEPROXY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
• ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA
• ANY COSTS OF SUBSTITUTE SERVICES
• ANY DAMAGES ARISING FROM USE OR INABILITY TO USE THE SERVICE

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU PAID TO US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless ServeProxy and its affiliates, officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you cache or distribute through the Service
• Any breach of your representations and warranties

10. Service Modifications and Termination

10.1 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10.2 Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Abuse of the Service
• Exceeding usage limits
• Illegal activity or court orders

Upon termination, your right to use the Service will cease immediately. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Third-Party Services

The Service integrates with third-party services, including Cloudflare's CDN network. Your use of the Service may be subject to additional third-party terms:

• Cloudflare: Subject to Cloudflare's Terms of Service and Privacy Policy
• Redis: Used for caching and rate limiting
• ImageMagick: Used for image processing

We are not responsible for the availability, accuracy, or functionality of third-party services. We do not endorse or make any representations regarding third-party services.

12. Geographic Restrictions

The Service is provided from servers located worldwide. We make no representation that the Service is appropriate or available for use in all locations. Access to the Service may not be legal for certain persons or in certain countries. If you access the Service from outside your jurisdiction, you do so at your own risk and are responsible for compliance with local laws.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ServeProxy operates, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the appropriate courts, as applicable in your jurisdiction.

13.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ServeProxy regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and ServeProxy as a result of these Terms or use of the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically. If you do not agree to the modified Terms, you must stop using the Service.
